White House Releases Gain-of-Function Ban, Leaving NIH Implementation Rules Still Pending

The Trump administration's July 28 policy formally prohibits federally funded dangerous gain-of-function research and restricts international life sciences collaborations, but agency-level rules have yet to follow, leaving hundreds of paused studies in limbo.

The federal government published its long-awaited replacement for the gain-of-function oversight framework on July 28, more than a year after the underlying executive order created the vacuum it was meant to fill. The document, titled the U.S. Government Policy for Stopping High-Risk Life Sciences Research, carries a July 20 date on its face and was announced by NIH Director Dr. Jay Bhattacharya.

The backstory matters here. Executive Order 14292, signed May 5, 2025, had immediately suspended new federal funding for what the order defined as "dangerous gain-of-function research" and directed OSTP and the National Security Advisor to produce a replacement oversight framework. According to a policy tracking notice published by CASRAI, the order set three internal deadlines at 90, 120, and 180 days from signing. All three passed without a replacement policy landing.

What arrived July 28 is now that replacement. According to a notice published in the NIH Grants & Funding portal (NOT-OD-26-101), the new government-wide policy "defines areas of life sciences research that pose the greatest risk to our nation's security, implements federal funding prohibitions, and establishes a framework for addressing risk and ensuring compliance." According to a legal client alert reviewed from Butler Snow, the policy also "establishes new restrictions for certain international life sciences research" and creates new certification, monitoring, and reporting obligations for institutions holding federal life sciences awards.

The enforcement architecture has teeth on paper. According to the same client alert, consequences for noncompliance can include "immediate revocation of ongoing federal funding" and "up to five years of ineligibility for federal life sciences funding." False negative attestations are specifically called out as conduct that may trigger revocation, which means institutional biosafety offices now carry a meaningful legal exposure they didn't carry under the prior DURC/PEPP framework.

The international restriction component is the part that's drawn the least public attention and probably deserves more. According to the HHS press release dated July 28, the policy "prohibits federal support for dangerous gain-of-function research conducted in the United States and abroad" and restricts funding "for research conducted in countries or institutions that lack appropriate biosafety, biosecurity, and oversight standards." The CASRAI notice, published in July, had already flagged a related concern: the original executive order directed OSTP to develop a strategy covering dangerous gain-of-function research that occurs without federal funding, work the prior DURC/PEPP framework couldn't reach because it operated entirely through funding agreements. Whether the July policy addresses that unfunded-research gap is not yet clear from public-facing documents.

Two structural questions remain open. First, NIH's own notice (NOT-OD-26-101) confirms that all research activities paused under the May 2025 executive order "remain paused until NIH specific implementation requirements are established." The government-wide policy has been issued; the agency-level rulebook has not. That gap is where researchers are currently sitting. Second, a Frontiers in Bioengineering and Biotechnology policy review published August 31, 2026, by UNSW Sydney's Ruihan Zhang noted that governance systems for dual-use research "remain fragmented across national boundaries" and that advances in synthetic biology, gene editing, and AI have expanded the pace and diffusion of high-risk biological work faster than any single national framework can track. A domestic prohibition on federal funding is a meaningful boundary. It's not a biosecurity perimeter.

The Foreign Affairs Forum flagged a related gap in May: as of early 2026, no country had enacted legislation formally requiring commercial gene synthesis providers to screen DNA orders for dangerous sequences. The July policy doesn't appear to address the commercial synthesis screening question directly, which means the chain of custody for potentially dangerous biological starting materials still runs through a voluntary compliance regime in the private sector.

Confidence assessment on the implementation timeline: low. The administration missed three statutory deadlines on the predecessor document. NIH says it's working with interagency partners on specific implementation requirements, but no date has been published.
