Almost Human — Terms of Service

Welcome to Almost Human, a product of Mission Possible Institute LLC, d/b/a Emerging Technologies Laboratory ("the Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Almost Human website and any related applications, features, and content (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.

2. What the Service Is

Almost Human allows you to have a text-based conversation with one or more AI-driven "agents," fictional personas with generated backstories and a real-time, instrumented emotional-state display. You may optionally provide a display name and enable a "remember me" feature, which allows the Service to recall details from prior conversations tied to your browser or device. The Service also presents a brief survey after a conversation ends, asking how human the conversation felt; your response, along with anonymized and aggregated conversation data, may be used for research and product improvement purposes as described in Section 6.

One-on-one conversation with a single agent is free, subject to a daily message limit. A paid tier is available on a monthly subscription basis; it removes the daily limit and unlocks group conversation ("table chat") with multiple agents at once, drawing on a monthly allotment of messages that can be supplemented with additional one-time purchases. Group conversation is only available on the paid tier. Current limits, allotments, and pricing are shown in the Service itself and may change; we will not reduce what a given billing period already includes after you have paid for it.

Not a real person; not professional advice: Agents are AI characters, not real people, medical professionals, therapists, or licensed counselors. Nothing an agent says is medical, mental-health, legal, or financial advice. If you are in crisis, experiencing suicidal thoughts, or in danger, contact 911 (US) or your local emergency number immediately, or a crisis line such as 988 (US Suicide & Crisis Lifeline).

3. Accounts and Memory

The Service does not currently require creating a password-based account. If you enable "remember me," the Service associates conversation memory with a persistent identifier tied to your browser or device, not with the display name you type in. Using multiple self-chosen names in the same browser may result in agents recalling details from more than one of your prior conversations, because memory is tied to the device, not the name.

4. Acceptable Use

You agree not to:

Automated use: You must be a human to use the Service in the ordinary course. Automated interaction with the Service, including scripted messages, scraping, data mining, or bot-driven conversations, is prohibited except as authorized in writing by the Company for security testing, academic research, or quality-assurance purposes.

5. Content and Intellectual Property

As between you and the Company, you retain ownership of the messages you personally write and submit to the Service ("your input"). Agent responses, agent backstories, character art, and the underlying Service technology are owned by the Company or its licensors. By using the Service, you grant the Company a non-exclusive, worldwide, royalty-free license to store, process, and use your input as necessary to operate, maintain, and improve the Service, and, in de-identified, aggregate form only, for research purposes as described in Section 6.

6. Research Use and the Exit Survey

If you complete the post-conversation survey, your numerical response and any optional free-text answer may be included, in aggregate and without directly identifying information, in research conducted by or on behalf of the Company, including research submitted for review by an Institutional Review Board (IRB) or comparable ethics body.

7. Content Moderation and Termination

The Company may review, restrict, or remove content, and may suspend or terminate your access to the Service, at its discretion, including for violations of Section 4. The Service is designed to pause or end a conversation if it detects content that crosses the lines described in Section 4; you will be notified in-conversation if this occurs.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AGENT RESPONSES ARE GENERATED BY AN AI SYSTEM AND MAY BE INACCURATE, INCOMPLETE, OR INAPPROPRIATE FOR YOUR SITUATION. YOU ARE SOLELY RESPONSIBLE FOR HOW YOU USE AND RELY ON THE SERVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY. IN NO EVENT SHALL THE TOTAL LIABILITY OF THE COMPANY EXCEED THE AMOUNT YOU PAID THE COMPANY, IF ANY, IN THE PAST TWELVE MONTHS FOR THE SERVICE.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Dayton, Ohio, and you hereby consent to the personal jurisdiction of such courts.
